Article 1 – Definitions
In these general terms and conditions, the following terms are used:
- "Entrepreneur": Chiq&Street, located at Zilverberg 190, Chamber of Commerce number: 42075729, email: info@chiqandstreet.nl.
- "Consumer": the natural person who is not acting for purposes relating to their trade, business, craft or profession.
- "Distance contract": a contract concluded between the entrepreneur and the consumer within the framework of an organized system for distance selling of products.
- "Right of withdrawal": the consumer's option to waive the distance contract within the cooling-off period.
- "Cooling-off period": the period within which the consumer can exercise their right of withdrawal.
- "Product": the goods supplied by the entrepreneur to the consumer, including clothing, accessories and related items.
- "Webshop": the entrepreneur's website where products are offered.

Article 3 – Applicability
- These general terms and conditions apply to every offer made by the entrepreneur and to every distance contract concluded between the entrepreneur and the consumer.
- Before the distance contract is concluded, the text of these general terms and conditions will be made available to the consumer.
- If the distance contract is concluded electronically, the text can be made available to the consumer electronically.
- In the event of conflicting terms and conditions, the consumer can always invoke the applicable provision that is most favorable to them.
- The entrepreneur reserves the right to amend these general terms and conditions. The amended terms and conditions apply to new orders.
Article 4 – The Offer
- If an offer has a limited period of validity or is made subject to conditions, this will be explicitly stated.
- The offer contains a complete and accurate description of the products offered. Colors may vary slightly due to screen settings.
- Every offer contains such information that it is clear to the consumer what the rights and obligations are.
- Obvious mistakes or errors in the offer do not bind the entrepreneur.
Article 5 – The Agreement
- The agreement is concluded at the moment the consumer accepts the offer.
- The entrepreneur will immediately confirm receipt of the acceptance electronically.
- The entrepreneur will take appropriate technical and organizational measures to secure the electronic transfer of data.
- The entrepreneur is entitled to refuse an order or to attach special conditions to its execution.
- When delivering products, the agreement is limited to a maximum of the available stock.
Article 6 – Right of Withdrawal
6.1 Cooling-off period
- The consumer has the right to withdraw from the agreement within a cooling-off period of 14 calendar days without giving any reasons.
- The cooling-off period starts on the day after the consumer has received the product.
- During the cooling-off period, the consumer will handle the product and its packaging with care.
6.2 Exceptions to the right of withdrawal
The right of withdrawal does not apply to:
- Products that cannot be returned for hygienic reasons and whose seal has been broken after delivery (such as underwear, swimwear, and socks).
- Products that have been specially made to measure or personalized at the consumer's request.
- Products that are clearly personal in nature.
Article 7 – Exercising the Right of Withdrawal and Costs
- If the consumer wishes to exercise their right of withdrawal, they must notify this within the cooling-off period via: info@chiqandstreet.nl.
- As soon as possible, but within 14 days, the consumer will return the product.
- The consumer will return the product with all supplied accessories, in its original condition and packaging.
- The risk and burden of proof for the correct and timely exercise of the right of withdrawal lies with the consumer.
- The consumer bears the direct costs of returning the product, unless the entrepreneur has indicated that they will bear these costs.
- If the consumer exercises their right of withdrawal, all additional agreements will be dissolved by operation of law.
Article 8 – Entrepreneur's Obligations in case of Withdrawal
- The entrepreneur will reimburse all payments within 14 days following the day on which the consumer reports the withdrawal.
- The entrepreneur will use the same payment method for reimbursement as the consumer used.
- If the consumer has chosen a more expensive delivery method, the entrepreneur does not have to reimburse the additional costs.
- The entrepreneur may wait with reimbursement until they have received the product.
- The entrepreneur may refuse or reduce the reimbursement if the product has not been returned in the proper condition.
Article 9 – Prices and Payment
- The prices stated in the offer include VAT.
- The entrepreneur is entitled to change their prices, but will inform consumers about this in good time.
- The consumer must immediately report inaccuracies in payment details.
- The webshop offers the following payment options: iDEAL, credit card (Visa/Mastercard), PayPal, Klarna, and Bancontact.
- In case of non-payment, the entrepreneur has the right to cancel the order or to charge statutory interest and collection costs.
- Discount codes are valid once, cannot be combined with other promotions and have a limited validity period.
Article 10 – Delivery and Execution
- The entrepreneur will exercise the greatest possible care when executing orders.
- The place of delivery is the address that the consumer has made known to the entrepreneur.
- The maximum delivery period is 30 days, unless a different period has been agreed.
- The standard delivery times used by the entrepreneur are indicative.
- The risk of damage and/or loss rests with the entrepreneur until the moment of delivery.
- Orders are usually offered with track & trace information.
Article 11 – Conformity and Warranty
- The entrepreneur guarantees that the products comply with the agreement and the specifications stated in the offer.
- A warranty scheme does not affect the consumer's statutory rights.
- Complaints about visible defects must be reported in writing within 2 months of discovery.
- Further agreements about the warranty period are stated on the product page.
Article 12 – Complaints Procedure
- Complaints must be submitted fully and clearly described within a reasonable time via info@chiqandstreet.nl.
- Complaints submitted to the entrepreneur will be answered within 14 days.
- The consumer must give the entrepreneur at least 4 weeks to resolve the complaint.
- A complaint does not suspend the entrepreneur's obligations.
- If a complaint is found to be justified, the entrepreneur will replace or repair the products free of charge.
Article 13 – Disputes
- Only Dutch law applies to agreements.
- Disputes can be submitted to the Disputes Committee for Home Shopping, Postbus 90600, 2509 LP The Hague (www.sgc.nl).
- A dispute will only be handled if the consumer has first submitted their complaint to the entrepreneur.
- The decisions are made by way of binding advice.
- The European Commission offers an ODR platform via https://ec.europa.eu/consumers/odr.
Article 14 – Additional and Deviating Provisions
- Additional or deviating provisions must not be to the detriment of the consumer and must be laid down in writing.
Article 15 – Personal Data and Privacy
- The entrepreneur processes personal data in accordance with the privacy statement on the website.
- The entrepreneur processes personal data exclusively for the execution of the agreement, customer account, newsletters (after consent) and legal obligations.
- Personal data will never be provided to third parties without consent.
- The consumer has the right to access, rectify, erase and portability via info@chiqandstreet.nl.
- The entrepreneur applies appropriate measures to secure personal data.
Article 16 – Intellectual Property
- The entrepreneur retains all intellectual property rights to all content on the webshop.
- The consumer is not permitted to copy or distribute the content without written permission.
Article 17 – Amendment of Conditions
- The entrepreneur reserves the right to amend or supplement these general terms and conditions.
- Changes will be communicated in good time and will take effect 14 days after announcement.
- If the consumer does not agree, they have the right to terminate the agreement.
